Rental Agreement: The Renter understands and agrees that signing this contract constitutes a legal binding agreement with Clarinet World.
Payment and Billing: This is a Rent-to-Purchase agreement. Monthly payments will be automatically charged to the Renter’s credit card on file. The Renter may update this payment method at any time by contacting CW directly. If a card is declined, CW will make up to two (2) additional attempts to process the payment. If the card continues to be declined, the Renter must promptly provide an alternative form of payment or return the clarinet immediately to CW.
Late Fees and Default: If any payment is more than thirty (30) days past due, CW will assess a late charge of $20.00 for each month payment is past due. In the event of a three (3) month default in payments, CW is authorized to reclaim the clarinet from the student's school or any other mutually agreed-upon location.
Termination for Non-Payment: Failure to make a payment for ninety (90) days may, at the sole discretion of CW, result in the automatic termination of this Agreement. Upon termination, all past-due fees become immediately due and payable.
Collections and Bankruptcy: If this contract is placed with a collection agency or attorney, the Renter agrees to be responsible for all associated legal and collection fees. If the renter declares bankruptcy, the renter agrees to promptly return the clarinet to CW (or arrange for its pickup). Upon safe return of the clarinet, CW agrees to dismiss any outstanding past-due balances.
Cancellation and Instrument Return: This is a Rent-to-Purchase agreement. The renter may cancel this contract at any time by providing thirty (30) days' written notice. The contract will officially terminate at the end of the current billing cycel in which the cancellation notice period concludes. The renter must return the clarinet by the end of that final month. If the clarinet is not returned, the contract and monthly billing will continue until the instrument is received by CW. Only full monthly payments are accepted; prorated refunds will not be issued. THE CANCELLATION IS ONLY PROCESSED IN STORE AND WHEN THE CLARINET IS RETURNED.
Instrument Condition upon Return: All clarinets must be returned in good working order. If repairs are required upon return, the cost of such repairs will be billed alongside the final rental payment, unless a valid maintenance agreement is actively in place.
Loss due to excessive damage or theft: In the event the clarinet is damaged beyond repair, subject to theft or loss without recovery, the balance of the account must be paid in full immediately.
Title and Security Interest: CW retains full title to and a security interest in all goods until the clarinet is paid in full according to the payment schedule. The renter has no right to sell, pawn, pledge, or otherwise encumber the clarinet. Upon default by the renter, CW shall possess, in addition to the remedies contained herein, all rights set forth under the Texas Uniform Commercial Code (UCC).
Immediate Return upon Termination: If this Agreement is terminated for any reason, the renter must return the clarinet to CW immediately.
Early Purchase Option: The renter may purchase the instrument at any time by paying the remaining total balance due at the conclusion of the current month’s billing cycle.
Maintenance Coverage: Maintenance is required for all rental contracts. The monthly maintenance fee is $10.
Included in maintenance coverage:
Covered Adjustments and Repairs: All adjustments and repairs required to maintain the instrument in proper playing condition - including those necessitated by normal wear and tear or accidental damage - shall be performed by CW at no additional charge.
Woodwind Mouthpiece Replacement: Broken mouthpieces are explicitly excluded from full coverage.
Authorised Service Only: All repairs, adjustments, and maintenance must be performed exclusively by CW. Any attempt by the Renter or an unauthorised third party to repair or modify the clarinet will immediately void this coverage, and the Renter will become fully liable for any subsequent repair costs.
Excluded from maintenance coverage:
Cosmetic Components: Replacement of lost or damaged parts that do not directly affect the playing function and mechanical ability of the instrument.
Consumables and Accessories: Everyday accessories and expendable supplies including, but not limited to: reeds, valve/key oil, swabs, lyres, neck straps, and lost mouthpieces.
Minor Aesthetic Damage: Dents, scratches, or bends that do not alter the playing functionality of the clarinet, as well as any deterioration of the clarinet's finish not otherwise covered by the original manufacturer’s warranty.
Loss or Theft Due to Negligence: Loss or theft resulting from a lack of reasonable care. Examples include but are not limited to: leaving the Clarinet on public or school transit, leaving it unattended in public areas (such as playgrounds or parks), or leaving it in unsecured, unlocked vehicles or facilities.
Intentional Misuse: Deliberate, malicious, or severe damage resulting from misuse, as determined at the sole discretion of CW.
